Tomoyo App Terms of Service

These Terms of Service (“Terms”) describe the rules for using Tomoyo App's websites, apps, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms.

What Tomoyo is

Tomoyo App is a companion-style toolkit designed to help people communicate, reflect, and stay organized around relationships and personal growth. Depending on what you enable, the Services may include journaling, check-ins, reminders, customizable forms, private notes, goal tracking, and educational content.

Tomoyo is not emergency support. Do not use Tomoyo for crisis situations or urgent medical, mental health, or safety needs. If you believe you or someone else may be in danger, contact local emergency services immediately.

Who can use Tomoyo

  • You must be at least 18 years old to use the Services.
  • You must have the legal capacity to enter into these Terms.
  • If you use Tomoyo on behalf of an organization, you represent you have authority to bind it.

Accounts and security

  • You're responsible for the accuracy of the information you provide and for safeguarding your account.
  • You agree not to share your password or access tokens, and not to use another person's account.
  • If you suspect unauthorized access, notify us promptly.

Use Tomoyo as intended, or we may suspend access

You agree to follow these Terms and our Acceptable Use Policy. You may not misuse the Services or help anyone else do so.

  • No illegal activity, harassment, threats, stalking, or doxxing.
  • No content involving minors, exploitation, or non-consensual sexual content.
  • No attempts to break security, scrape private areas, reverse engineer, or disrupt the Services.
  • No uploading malware, running bots that overload the system, or abusing APIs (if provided).
  • No impersonation or misrepresentation of identity or affiliation.

We may investigate violations and suspend or terminate accounts where appropriate, including to protect users, comply with law, or prevent harm.

Consent and safety matter here

Tomoyo may include tools that users apply to sensitive relationship contexts. You are solely responsible for how you use the Services and for ensuring your conduct is consensual, lawful, and safe.

  • You agree not to use Tomoyo to coerce, manipulate, or monitor someone without their knowledge and consent.
  • You agree not to use Tomoyo to facilitate abuse, intimidation, or non-consensual activities.
  • If you share content with others, you confirm you have the right to share it and that it is appropriate.

Your content stays yours, and you give us limited permission to run the service

“User Content” includes anything you submit, upload, store, or generate through the Services (for example: notes, form responses, images, and messages). You own your User Content.

To operate the Services, you grant Tomoyo, a product of Yuuyoo Consulting LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your User Content solely to provide, secure, and improve the Services (including backups, abuse prevention, and troubleshooting).

You represent and warrant that you have the rights to provide User Content and that doing so does not violate any law or third-party rights.

Privacy

Our Privacy Policy explains what data we collect, how we use it, and the choices you have. By using Tomoyo, you agree to our Privacy Policy.

We're not responsible for third-party services

The Services may integrate with or link to third-party products and services (for example: payment processors, analytics, email delivery, app stores, or external links). Those third parties have their own terms and policies, and your use of them is at your own risk.

Payments and subscriptions

Some features may require payment (including one-time purchases, founder tiers, or subscriptions). If you purchase a paid plan, you agree to pay the listed fees, taxes, and any applicable renewals.

  • Billing: Payments are processed by our payment provider(s). We do not store full payment card numbers.
  • Renewals: Subscriptions (if offered) renew automatically unless canceled before the renewal date.
  • Refunds: Refunds (if any) are provided according to our posted refund policy or as required by law.
  • Price changes: We may change prices with advance notice as required by law or app store rules.

Founders / early access: If you offer a “Founder” plan, describe it clearly on the Pricing page. The Founder plan should not be interpreted as a security, investment, or ownership interest in Tomoyo, a product of Yuuyoo Consulting LLC.

If you send feedback, we may use it

If you provide suggestions, ideas, or feedback, you grant us permission to use it without restriction and without compensation, to improve Tomoyo and related products.

Our intellectual property

Tomoyo, a product of Yuuyoo Consulting LLC and its licensors retain all rights, title, and interest in the Services, including software, design, branding, and trademarks. These Terms do not grant you any right to use our trademarks or brand assets without written permission.

We may change the Services, and we may suspend or terminate access

We're always improving Tomoyo. We may add, remove, or modify features, and we may suspend or end the Services (in whole or part). Where reasonably possible, we'll provide notice of major changes.

We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Services or users. You may stop using the Services at any time.

We do not provide professional advice or warranties

Tomoyo may provide educational content, prompts, and tools. It is not medical, mental health, legal, or financial advice, and it is not a substitute for a qualified professional.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” Tomoyo, a product of Yuuyoo Consulting LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We limit our liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Tomoyo, a product of Yuuyoo Consulting LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL.

TO THE FULLEST EXTENT PERMITTED BY LAW, Tomoyo, a product of Yuuyoo Consulting LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS (US $100) IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to protect us from claims caused by your misuse

You agree to indemnify and hold harmless Tomoyo, a product of Yuuyoo Consulting LLC and its affiliates from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of these Terms or applicable law.

Governing law and venue

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Services will be brought in the state or federal courts located in [County], Michigan, and you consent to personal jurisdiction there.

Optional upgrade: many SaaS companies add an arbitration clause and class-action waiver here. If you want that, have an attorney tailor it to your state and product risk level.

We will notify you when these Terms change

We may update these Terms from time to time. We'll post the updated Terms on this page and update the “Last updated” date. If changes are material, we'll provide additional notice as required by law (for example, via email or in-app notice). Continuing to use the Services after changes become effective means you accept the updated Terms.
